A shop assistant named Muhammad Fitri Ishak, aged 26, has been fined RM5,000 by the magistrates' court for having a collection of explicit pictures and videos on his mobile phone. Fitri pleaded guilty to the charge when it was presented before magistrate Nur 'Atiqah Sapari.
Magistrate Nur 'Atiqah ruled that if Fitri failed to pay the fine, he would be required to serve eight months in jail. Fitri faced charges for possessing 67 pornographic pictures and 55 pornographic videos on his mobile phone. The incident is said to have taken place at a building in Taiping Hospital on February 16, 2022, at 12:15 PM.
Fitri was charged under Section 292 of the Penal Code, which allows for a maximum jail term of three years or a fine, or both. The prosecution was led by Siti Hajar Sulaiman, a prosecuting officer from the Malaysian Communications and Multimedia Commission. Fitri was represented by Ng Wei Jun, a lawyer from the National Legal Aid Foundation.
During the proceedings, Ng requested a lower fine for Fitri, considering his monthly income of RM1,200 and his responsibilities in supporting his parents and siblings. Fitri expressed regret for his actions.
The prosecution emphasized the importance of imposing a suitable sentence on Fitri as a lesson to the community. They also requested that the case be resolved in accordance with Section 260 of the Communications and Multimedia Act 1998.
Fitri paid the fine, resolving the matter.
