Eira Aziera, a prominent social media influencer, faced a setback as the Court of Appeal unanimously rejected her appeal to overturn the High Court's decision. The High Court had previously ordered her to pay RM100,000 in damages for using abusive language and body-shaming a female commissioner of oaths during a Facebook Live session three years ago.
The judges found that Aziera's appeal lacked merit.
In delivering the decision, Datuk Ahmad Zaidi Ibrahim stated that the Court of Appeal supported the High Court's judgment, agreeing that the words spoken by Aziera against Suharnizan Md Sidek constituted defamation.
Furthermore, the court found the RM100,000 in damages awarded by the High Court to be reasonable. The High Court's consideration of factors related to cyberbullying and body shaming in determining the damages was acknowledged.
Suharnizan, the plaintiff, filed the lawsuit on October 13th, 2020, following Aziera's use of abusive language, insults to her physical appearance, and the display of pictures of Suharnizan with her two children during a live video on Aziera's Facebook account under the name Eira Aziera. Suharnizan's legal action came after Aziera's comment during the live video on August 18, 2020, where she remarked, "live masak, live makan-makan, letak produk kurus, boleh kurus ke?"
Suharnizan alleged that Aziera's abusive words became viral on social media and were uploaded on Facebook pages such as 'Makcik Bawang Channel' and 'Makcik Kiah Channel,' both of which have a substantial following. The impact of Aziera's words tarnished Suharnizan's reputation, causing emotional stress, trauma, depression, and a loss of self-confidence.
