Muhyiddin Yassin, the President of Bersatu, has achieved an outcome in his favour in his application to dismiss four charges related to the alleged misuse of RM232.5 million from the party's funds, which were linked to the Jana Wibawa program.
The verdict was delivered by Judge Muhammad Jamil Hussin of the Kuala Lumpur High Court, who concluded that the charges against the former Prime Minister were flawed, lacking a basis, and vague, thereby deviating from the principles outlined in the Criminal Procedure Code.
Judge Jamil Hussin highlighted that the charges also failed to provide adequate particulars regarding the alleged offenses under the MACC Act 2009. This deficiency resulted in the accused's inability to furnish his legal representation with comprehensive instructions.
The court further contended that proceeding with the trial under these circumstances would hinder Muhyiddin from effectively mounting his defense, potentially infringing upon his right to a fair trial. Such a situation would compromise the integrity of the court process and the pursuit of justice.
Consequently, the Kuala Lumpur High Court issued an order to release Muhyiddin from the charges of abuse of power. It's important to note that these charges were still awaiting proceedings in the Kuala Lumpur Sessions Court.
Muhyiddin, aged 75, had initiated the legal process by submitting an application to challenge the charges on April 18. The public prosecutor was named as the respondent in this motion.
The former Prime Minister requested to be exonerated and acquitted from the four charges brought against him on March 10. Additionally, he sought to have the proceedings in the Sessions Court deferred pending the outcome of this application.
