Today former IT consultant Yew Wei Liang was sentenced to 16 years in jail by the high court for causing the death of bank manager Syed Danial Syed Syakir in a road-rage incident 4 years ago.
The 45yo was found guilty of culpable homicide not amounting to murder on Tuesday. Justice Julia said that the prosecution had proven its case beyond resonable doubt.
His sentence was announced to start from the date of his arrest, 10 Aug 2019.
He was charged under the Penal Code; 30 years and a fine. Today, Julia considered factors like background, first offence, cooperation during investigation and a right to a fair sentence.
Earlier the accused’s lawyer requested a minimum of six years saying that it was ‘clearly unfair and unreasonable’ for the court to attribute the death of the victim solely to Yew.
“The accused had no plan or intention to cause the victim’s death. Instead, it was an unfortunate accident involving two parties”, said the lawyer.
But the deputy public prosecutor of the case argued the accused be given heavy and prportionate sentence of between 21-25 years behind bars.
“A heavy sentence should be imposed on the accused to teach him and the public a lesson so that people dont make the same mistake if they are faced with difficult situations on the road”, said the deputy prosecutor.
However, according to the judge, the accused had acted beyond his right to self-defence by repeatedly running into the victim, although the threat against Yew was gone when the victim ran away.
On 10 Aug 2019, Yew repeatedly ran into Syed Danial on the North-South Expressway in Bandar Baru Bangi, resulting in his death at the scene.
