A court has ordered a non-Muslim man to pay compensation to the husband of his lover, resulting from their extramarital affair that led to the breakdown of their marriage. The 26-year-old man, residing in Baling, Kedah, was found culpable of engaging in an affair with a 32-year-old woman, resulting in the birth of a child.
Justice Mahazan Mat Taib of the Alor Setar High Court issued the order after accepting the husband's counter-petition. In his ruling, Justice Mahazan stressed the seriousness of the affair and adultery as factors contributing to the marriage's dissolution. He deemed the compensation amount of RM30,000 to be reasonable, considering the misconduct of both parties involved and intended it as a lesson for the general public.
The woman had previously filed a single divorce petition regarding their child under the Law Reform (Marriage and Divorce) Act 1976. Subsequently, the 38-year-old trailer driver from Sik filed a counter-petition, naming the man from Baling as a party and accusing him of committing adultery with his wife.
After filing the counter-petition, the man and the wife of the client's child left the country and have not returned. They also did not respond to the counter-petition. The husband's lawyer noted that they submitted various evidence to the court, including photos from the Facebook profiles of the man's family members involved in the affair.
Under civil marriage laws, the court has the discretion to order individuals found guilty of adultery in a married couple's relationship to pay compensation, serving as an example to society.
