MELAKA – A hotel employee was sentenced to 7 years in prison by the Sessions Court here today after he sexually assaulted a 15-year-old boy in the storeroom of the hotel.
Judge Elesabet Paya Wan passed the sentence on the accused, Malek Saifullizan Md. Husin, 35, who pleaded guilty as soon as the charges were read out by the court interpreter.
According to the charge, the accused who worked at a hotel was found to have committed physical sexual assault on a 15-year-old boy.
The action was carried out by the accused at about 5.30pm at a hotel in Taman Melaka Raya in the Melaka Tengah district on December 9.
For the offense, the accused was charged under 14 (a) of the Sexual Offenses Against Children Act 2017 which provides for a maximum jail term of 20 years and can also be punished with whipping.
According to the facts of the case, the victim checked in at the hotel with his family on December 9 and the accused, who was still single, invited the teenager to take a pillow in a storeroom.
However, the accused suddenly told the victim to lie on a bed before sexually assaulting him.
A colleague then entered the room and saw the victim on the bed. Before the victim left, the accused also warned to keep the incident a secret.
The accused, who was not represented by a lawyer, appealed for his sentence to be commuted on the grounds that he had to take care of his sick mother and sister.
The prosecution was conducted by Deputy Public Prosecutor, Anis Wahida Mohamad, however, requested that a heavy sentence be imposed taking into account that the crime committed was serious and left a traumatic effect on the victim.
After hearing the arguments of both parties, the court then sentenced him to seven years imprisonment and two years of supervision period after the accused completed his prison sentence.
