Following her arrest for Khalwat, a single mother in Terengganu has become the first woman in the state to be sentenced to caning by the Syariah High Court. Senior Judge Rosdi Harun of the Terengganu Syariah High Court imposed six strokes of the cane and a fine of RM4,000 after Nurfifi Amira Nawi, 37, pleaded guilty to the offence under Section 31(b) of the Syariah Criminal Offenses (Hudud and Qisas) (Terengganu) (Amendment) 2022 Enactment.
Nurfifi Amira admitted to being in Khalwat with a 40-year-old man who was not her husband or mahram at a house in Kemaman at 3:15 p.m. on January 31st.
Previously, she had been convicted under the same section in 2018 and was fined. Under the Syariah Criminal Offenses (Hudud and Qisas) (Terengganu) (Amendment) 2022 Enactment, repeat offences of Khalwat can result in a maximum punishment of six strokes of the cane, a fine of RM5,000, or three years' imprisonment.
Nurfifi Amira's sentence, who also has a child, is scheduled to be carried out on May 6th at Marang Prison if she fails to file an appeal within 14 days from yesterday. Additionally, she will face an 8-month imprisonment if she fails to pay the fine.
The judge also advised Nurfifi Amira to lawfully marry according to Shariah law to avoid committing Khalwat offences in the future.
