Seremban: A 55-year-old housewife who was accused of stabbing her husband to death on January 23 was ordered to undergo psychiatric observation at Permai Hospital, Johor Bharu, Johor, for a month.
The order was issued by Magistrate Norzaliza Tesmin against Lau Seck Yan after an application was made by lawyer Joshua Nga Koo Koy who represented the accused in the re-mention of the case at the Seremban Magistrate's Court, today.
Lau, who is also a former independent candidate for the Port Dickson by-election (PRK) in 2018, is charged with killing Poh Seng Hiap, a former private company accountant at a house in Rasah Kemayan, here, between 3.30pm and 4.30pm.
The charge is filed under Section 302 of the Penal Code which provides for the death penalty upon conviction.
Nga made the application after his client had a history of acting aggressively and violently that could have resulted in injury to family members.
Nga explained that his party had sent two affidavits in support of the argument which were signed by Lau's two daughters on 22 and 23 February.
"The woman's eldest child also lodged a police report on December 22 last year about his mother's health condition which required treatment.
"On December 19, 2021, they received a message via Whatsapp from their father who lived at home stating that he could not stand living with their mother because he often hurt her," he said during the proceedings.
Nga also told the court that the accused had also injured the victim several times and the matter was in the knowledge of the couple's child.
"They claimed that the accused had schizophrenia and their father also sent pictures of the injury. They had several times persuaded the accused to seek treatment, but she refused and continued to rage," he said.
Nga added that the woman's child also found a 'suicide note' in the accused's room a few days ago written in 2008 whose contents asked family members not to grieve if the accused died.
Nga said in the note, the accused also apologized to her husband if she hurt the victim physically and emotionally.
Thus Nga explained that his client was suffering from bipolar disorder and needed treatment before the prosecution stated that it had no objection to the application.
Norzaliza then ordered the accused to undergo observation at the facility for a month and re-mention the case on March 23 for a chemical report and a psychiatric report.
Media previously reported that the victim was found dead in the kitchen of their house after he was believed to have been stabbed twice in the chest and waist using a sharp weapon by his wife.
The couple have four children and at the time of the incident the third and fourth children were witnesses of the incident.
